Acknowledging the uncertainty concerning the end of the ongoing pandemic, the Industrial Property Section of the Department of Industries (hereinafter referred to as the “Department”) has issued a notice iterating following issues in regard to the renewal of patent, design and trademark authorized by the Department:

  1. Post prohibitory orders, the public vehicles within Kathmandu valley have been operating under the odd-even rule from September 10, 2020 (Bhadra 25, 2077) onwards. Considering the operation of public vehicles from the said date, the time limit for the applicants from within the valley, to be present at the Department for the renewal of patent, design and trademark, has been set 30 days from September 10, 2020, excluding the transportation period.
  2. With the inter-district operation of public vehicles and resumption of domestic and international flights from September 17, 2020 (Ashoj 1, 2077) onwards, for the service recipients from outside the valley concerning the renewal of patent, design and trademark, the time limit to be present at the Department has been set 30 days from September 18, 2020 (Ashoj 2, 2077), excluding the transportation period. 
  3. For the provision of (1) and (2), the address shall be as stipulated in the patent, design and trademark certificate accordingly.
  4. For those applicants not abiding by the given time limitation, the provisions set out under Section 23B of the Patent, Design and Trademark Act, 1965 shall be applicable. The referred Section provides that the renewal of such industrial properties can be made within 6 months of expiry of the time-limit by paying a fine of one thousand rupees (Rs. 1000). However, if the patent, design and trademark is not renewed in such a manner as well, such property shall be cancelled automatically.
